1. Acceptance of Terms
By accessing or using the Care Consult website, client portal, or any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services. These terms constitute a legally binding agreement between you and Care Consult.
2. Description of Services
Care Consult is a private clinical advisory and care coordination firm. Our services include, but are not limited to:
- Structured second opinions on diagnoses and treatment plans.
- Care navigation and coordination of specialist appointments.
- Accompaniment to medical consultations.
- Clinical report preparation and treatment plan summaries.
- Ongoing retainer-based advisory services.
- Video consultations with your assigned counsel.
3. Important Medical Disclaimer
Care Consult does not prescribe, diagnose, or provide medical treatment. We are a clinical advisory firm, not a healthcare provider. Our services are designed to help you navigate the healthcare system, understand your options, and coordinate your care. All medical decisions remain between you and your treating physicians. Our advisory opinions do not constitute medical advice and should not replace consultation with qualified medical professionals.
4. User Accounts and Responsibilities
When you create an account on our client portal, you agree to:
- Provide accurate, current, and complete information during registration and intake.
- Maintain the security of your account credentials and not share them with third parties.
- Notify us immediately of any unauthorised access to your account.
- Provide truthful and complete medical information to enable us to deliver effective advisory services.
- Accept responsibility for all activity that occurs under your account.
You must be at least 18 years of age to create an account. For minors, a parent or legal guardian must register and manage the account.
5. Confidentiality
We treat all client information with the highest level of confidentiality. Your medical records, case details, and personal information are protected under our Privacy Policy and the Kenya Data Protection Act, 2019. We will not disclose your information to any third party without your explicit consent, except where required by law.
You agree to maintain confidentiality regarding the proprietary methods, specialist assessments, and internal clinical intelligence shared with you during our engagement.
6. Payment Terms
Fees for our services are outlined in the engagement agreement provided before the commencement of services. Payment terms include:
- M-Pesa: Payment via Safaricom M-Pesa STK Push. You will receive a prompt on your registered phone number.
- Card payments: Processed securely through our payment partner. A processing fee of 3.5% applies to card transactions.
- Invoices are generated and accessible through the client portal.
- Payment is due within the timeframe specified in your engagement agreement or invoice.
- Outstanding balances may result in suspension of services until payment is received.
All prices are quoted in US Dollars (USD) unless otherwise stated.
7. Intellectual Property
All content on the Care Consult website and portal, including but not limited to text, graphics, logos, reports, clinical summaries, and software, is the property of Care Consult and is protected by Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
Clinical reports and summaries prepared for you as part of our services are for your personal use only and may not be published, shared publicly, or used for commercial purposes without our written permission.
8. Limitation of Liability
To the maximum extent permitted by Kenyan law:
- Care Consult shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
- Our total liability for any claim arising from our services shall not exceed the amount you have paid to us for the specific service giving rise to the claim.
- We do not guarantee specific medical outcomes. Our advisory services are based on professional judgment and available information at the time of engagement.
- We are not responsible for the actions, omissions, or malpractice of third-party medical professionals, hospitals, or specialists to whom we may refer you.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the Laws of Kenya. Any legal proceedings arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Kenya.
10. Dispute Resolution
In the event of any dispute arising from these terms or our services, the parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be referred to mediation under the rules of the Nairobi Centre for International Arbitration. If mediation is unsuccessful, either party may pursue remedies available under Kenyan law.
11. Termination
Either party may terminate the engagement by providing written notice. Upon termination:
- Any outstanding fees for services already rendered shall remain payable.
- You may request a copy of your data in accordance with our Privacy Policy.
- We will retain your records as required by Kenyan law and our data retention policy.
- Access to the client portal will be revoked following settlement of any outstanding obligations.
Care Consult reserves the right to suspend or terminate your account if you breach these terms, engage in fraudulent activity, or misuse our platform.
12. Amendments
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. For material changes, we will provide notice via email or through the client portal.
